Visa Query

    Just a thought-if i get offered a job, ideally ill go out in Jan next year, however im going to Florida on holiday in december,

    with the visa we would be on, is this allowed or do i have to give a certain period of time without entering the US prior to the start date on my Visa?

    I did this before (Went on holiday in November, went to work in december) but i dont know if the rules have changed since?

    when you go on holiday to America your not on a visa...you fill in the visa waiver form online which is for certain countries only...the visa waiver allows you to stay there for 3months so obviously not long term so there shouldn't be any problems with getting the visa for disney

    the only problem i can see is if you go after you've been to the embassy and have the visa in your passport...when i went my dad has a media work visa for the states in his passport so he just had to say that he was there this time for a holiday and wasn't working took an extra 5 or 10 minutes but was easy enough...but the visa we have has a start and end date which is obvious whereas his was valid for a certain number of years so is slightly different...

    but you do also have thing where your allowed in 30days before the visa starts and stay 30days after so it all depends if theres any crossover - thats the only issue i can see there being...

    Your two options are:

    1) Enter the country (for your Holiday) on the Visa Waiver Program. Leave the USA then return using your visa.

    2) Enter the US on your visa (max of 30 days before visa start date) and don't leave until the end of your program.

    You'll only have issues if you do option 1 and don't leave the country and re-enter using your visa.

    I think it also depends on whether or not you've already got your Visa by the time you go on holiday. If you have, it could complicate things slightly if you want to use the visa waiver program, since they'd probably see that you have a visa. You'd probably be okay, but you might want to look into that just in case it'll cause problems.

    Maybe I'm misunderstanding what you're saying, but as far as I'm aware, you can leave and return anytime on your visa, as long as you're within the start and end dates of it (the expiration date doesn't include the 30 days leeway).

    You can but your employer has to verify to the govt that you have actually turned up within the first week of the visa start date, which is why you can't enter during that first 30 days and then leave again. That's basically the only time you'll have major problems. I technically had (according to my passport) 2 valid US visas last summer but they know which one you're entering on so its not an issue. Similarly I've entered the US on the VWP while having an apparently valid US visa.
